Bridgewater Township

Regarding the lawsuit by Advanced BioEnergy, Judge Wolf returned a decision on 1/4/08, granting in part and denying our motion for summary judgment. As the court noted, the primary issue involved Count 1 – the alleged inconsistency between the county and township ordinances. The court reaffirmed a “township is expressly authorized to prohibit what the county might permit.” The court also rejected the other procedural challenges to the adoption of the comprehensive plan and zoning ordinance.
