Regarding the lawsuit by Advanced BioEnergy, Judge Wolf returned a decision on 1/4/08, granting in part and denying our motion for summary judgment. As the court noted, the primary issue involved Count 1 – the alleged inconsistency between the county and township ordinances. The court reaffirmed a “township is expressly authorized to prohibit what the county might permit.” The court also rejected the other procedural challenges to the adoption of the comprehensive plan and zoning ordinance. More information will be posted here as it becomes available.
